The Bavarian Office for the Protection of the Constitution is targeting the AfD Bavaria as a whole party. As the “Süddeutsche Zeitung” reported in the evening, citing a spokesman for the Bavarian Ministry of the Interior, the observation has already started.
Telephone monitoring of the AfD is now also possible
First, the Munich Merkur had reported. So far, only individuals, the formally dissolved AfD group “Flugel” and the youth organization “Junge Alternative” have been under observation in the state. This status means that the Office for the Protection of the Constitution can also use intelligence tools, such as telephone surveillance or the use of informants, if necessary.
Main question: Does the AfD contradict the free democratic basic order?
According to the Office for the Protection of the Constitution, the “ethnically homogeneous concept of the people” represented in particular in the wing is problematic, it “contradicts the central basic principles of the free democratic basic order,” quotes the SZ. The Federal Office for the Protection of the Constitution had already made the AfD federal party and its youth organization an object of observation in March 2021. States such as Baden-Württemberg and most recently Hesse have followed suit at state level.
AfD members of the state parliament are not observed
Excluded from the observation are the AfD deputies of the Bavarian state parliament. According to the ministry spokesman, they are protected by their free mandate. The Federal Constitutional Court had set high hurdles for the intelligence service to monitor MPs.
