Four key writings in the case of the disappearance and alleged femicide of a 17-year-old teenager were missing for years. But, in the days before the start of the trial, they were found in a box of evidence that was in the prosecutor’s office. It was suspected that these manuscripts corresponded to the main accused of having killed and hidden the body of Daiana Garnica in 2017. Another of the central blocks of this framework were these four papers that reveal an “obsession” of the defendant with the victim, according to the investigators.
In the writings there is talk of a Daiana. In one of them she asks him “to go with him to buy a gift for my mommy”, and it was precisely that same argument that she used in the last conversation they had on WhatsApp so that the young woman would leave her house. But on the paper identified in the expertise as “D” she mentions that same name, she says “my love” and assures: “I’m going to take you to my eternal place.”

“On a piece of paper, he wrote the same thing that he sent Daiana on Whatsapp. In another, a kind of confession: ‘Daiana, beautiful as a child, has been like my daughter but I can’t take it anymore, my love, what do I do? I’m going to take you to my eternal place. She won’t say it, but she has written it. And a third piece of paper that might be a checklist. What do I have to do: wash the car, wash clothes, in the brickyard. This, this, this”, he listed the legible part of the list that they attributed to the accused and interpreted as a kind of list of the steps to follow following the crime.
The start of the trial was planned for last April 10, but it began two days later due to the recovery of that evidence. Criminologist Cristina del Valle Ybarra compared the pressure of the writing, the features and the inclination of the letters, among other technical issues, to determine if those manuscripts were made by the defendant. And she indeed found a match between them and a text that the suspect had subsequently written for the expertise. She thus concluded that Suárez was the author of those texts.
While Suárez’s defense questioned the chain of custody of that evidence during his final arguments. And he pointed out that “no DNA was found” of the defendant in those papers.
As determined by the investigators that Saturday, May 6, 2017, Suárez sent Daiana a message at 6:41 p.m. to ask her to accompany him to buy a gift for her mother, but asked her to delete the messages and not tell her family that I was going to be with him. The justification was that the gift was a surprise.
The young woman ignored him. She told her mother that Suárez would take her to buy the sweets that she had ordered before her for her family kiosk and left her cell phone at her house. Since Daiana did not return, they rebuked Dario and checked his phone, but he had no messages with the teenager. But later, the Garnica found the minor’s device and there they confirmed the meeting between the two.
The prosecution requested a life sentence for Suárez, while the defense requested his acquittal. Judges Rafael Macoritto, Dante Ibáñez and Diego Lammoglia will give their verdict next Tuesday.

Daiana Garnica’s trial is not the first to take place in Tucumán without the body being found. There are two precedents in which the defendants ended up convicted of the disappearance and homicide of the victims. One is the case of the teacher Beatriz Argañaraz (45) and the other is the femicide of Milagros Avellaneda (26) and her son Benicio (2).
Beatriz disappeared in 2006 and the two ex-nuns Nélida Fernández and Susana Acosta were sentenced to 20 years in prison for the incident. According to the investigation, her defendants had summoned her to her apartment and they killed her there.
