The Murder Trial of Anneliese Audain and Didier Bauwens: A Detailed Case Analysis by the General Counsel

Difficult to summarize a week of debates in two hours. However, the representative of the public prosecutor’s office was concise on Monday followingnoon in her indictment.

Who committed the crime? The prosecution has not changed its mind following a week of trial, the perpetrators are the accused! “It’s a thoughtful murder, constructed step by step, by two perpetrators,” said Vanessa Samain.

Inseparable

She adds that the accused are inseparable in this case, “the elements which exist for one, exist for the other”. The attorney general continues by stating that the two accused are not their first attempts. “They created a false invoice when Anneliese’s dad died, so that she might benefit from 2,000 euros, to which she was not entitled.”

During the trial, Didier Bauwens was compared by those close to him to a dog, which runs when Anneliese Audain whistles. “According to those around him, he changed around 2018-2019, when Luis started to be absent. He does his shopping, does the taxi, does his laundry. He does everything for his dear Lise. Even when she is incarcerated, he goes through a third party to replenish her canteen account.”

For the prosecution, the assassination of Luis is a plan put in place by two people, who exchanged thousands of messages, some of which disappeared, between January 1 and February 18, 2020, the day following the crime.

The plan fails

Vanessa Samain explains that the plan, consisting of a disappearance, failed. “They decided together to make Luis Gonzalez disappear and their plan failed because of a large rock that prevented the car from sinking. The scenario was to make it appear that Luis Gonzalez Rojas had disappeared. No third party might have envisaged this plan of disappearance. Their plan might not work and we had to adapt”.

With a disappearance, no body, no toxicology, no Diazepam, perhaps no more ballistic traces… Everything would have been different.

The debts

The General Counsel shares the chronological analysis presented by the civil party lawyers earlier today.

2018, the Gonzalez-Audain couple struggles and separates for the first time. Anneliese was already interested in Diazepam, a few months before this anxyolitic was dispensed by her doctor.

Conversely, Luis earns a good living. From Spain he sends several thousand euros “noting in communication furniture and not sorry”, as during the transfer at night crime. The prosecution notes that she bought nothing with this money, more than 5,000 euros in one week. She asked him for 5,000 more, using Luis’s card following his death for several thousand euros. “Luis’s account was siphoned off for furniture she didn’t buy.”

Diazepam, weapon, channel: research on the Net

Here we are on February 9, 2020, Luis returns and is missing 20,000 euros to buy the chalet. “Didier Bauwens’ research began on February 2, with Diazepam, the weapon, and the canal.” This is the way to go. Sometimes the research is joint, done in the same place, together.

On February 11, Francesco delivered the 22 caliber rifle to Claude, Didier’s brother. This following a series of coded messages, the famous muffler for the weapon, exchanged between Didier and his half-brother, Claude Nitelet. “As the exhaust is twisted, we make touching ends and blank ends, as in the file,” says the general attorney.

An anonymous denunciation delivered the chain: owner of the weapon-Francesco the Italian-Claude Nitelet-Didier Bauwens. The prosecution believes that Francesco’s affidavit is credible. “His statements are corroborated by SMS and anonymous information.”

The prosecution adds that Claude Nitelet did not want to harm his brother in his statements to the police. You therefore need someone who has contacts and Claude has them,” insists the general counsel.

From Friday February 14, Didier Bauwens developed a sudden passion for the canal. He went there twenty to thirty times, “scouting”, on February 14 and 15.

The evening of the crime

During the day of Sunday February 16, Anneliese Audain’s telephone calls allow us to conclude that she spent time with Didier Bauwens.

In the evening, Anneliese Audain ensures that her two children and Luis’s son are no longer at home. She rushes to take Luis’ son back to his mother’s house, even though he is scheduled to return on Monday. “At all costs, the child must return to his mother and Luis must be alone at home.”

Luis is alone at home, he is sleepy according to his son. The only person who says he uses Diazepam is Anneliese Audain. The toxicological examination shows the opposite, a single dose. “And it was given at a time when there are three people in the house, Luis, his son and Anneliese. The latter writes to Didier Bauwens that he is in gas and that he has difficulty walking”.

According to the report, Luis died three hours following eating his meal. “The most likely hypothesis is a time of death between midnight and 2:30 a.m.”.

At 11:37 p.m., Anneliese sends a message to Luis, informing him that she is returning from Tubize. He does not answer. “But Didier Bauwens receives messages, little ones. He knows that Luis is alone in the house and he is the only one who knows it. Luis is available and the doggie Didier is ready to do everything for her.”

A gap of one hour and eight minutes

The prosecution notes that, for an hour and eight minutes, it was unclear what Anneliese was doing. She has no activity by telephone or Internet, while Luis is not at home. The accused denies having gone to the canal. However, the prosecution shows that she went there that night, the telephone and video images prove it.

According to the attorney general, the crime took place in the house on rue de l’Egalité. However, no gunshot residue or traces of blood were found in the house. “There is residue on Madame Audain’s bag, wallet and key.”

Vanessa Samain thinks that Luis was shot while he was lying in the tarpaulin, “in order to collect as many traces as possible”.

Anneliese returns home around one o’clock at night and Luis’s phone is activated. She came out later and, according to the prosecution, she met Didier Bauwens around 2:24 a.m. She returns home ten minutes later and makes transfers “following the maximum time of death according to the coroner, at a time when she is alone at home”. On Monday, the accused declared “it was him or me”. For the prosecution, there is no doubt that it was her.

For the prosecution, these transfers are decisive “because they are proof that Luis did not leave”.

After all that, there are bleach cleanings… “unusual cleanings”.

Defense attorneys will enter arguments Tuesday. Didier Bauwens’ lawyers will begin.
