The provincial court ruled in first instance in favor of a 53-year-old woman who was injured in the center of Rosario as a result of a pothole. The incident occurred on January 8, 2015 when the victim tried to cross at the corner of Rioja and Paraguay and tripped over a well on the road.
As a result of the fall, the woman suffered severe injuries and they ended up diagnosing him with a 33 percent disability. Given this, he decided to initiate a lawsuit once morest the municipality, since it is in charge of preserving the good condition of the city’s streets.
“The municipality is responsible for guarding the sidewalks and roads, for keeping them in good condition. In addition, these types of issues have to be resolved quickly so that the person does not have any type of risk, ”explained the sponsoring lawyer Luis Galigani in dialogue with the Tiempo de Justicia program.
According to the ruling, the municipality must pay the woman 3,824,800 pesos plus interest. According to the lawyer, this amount to date would reach $6,120,000.
In addition, Galigani clarified that before making a judicial presentation They tried to go through administrative channels. “But the responses of the municipality are automatic on these kinds of issues and that ends up generating damage because the money to pay for this comes from all citizens,” he lamented.
It should be noted that the conviction was from the Court of Extracontractual Responsibility No. 2 of Rosario and that the municipality still has the possibility of appealing the ruling. But as explained by the victim’s lawyer, “being a collegiate court, the only possible appeal is extraordinary.” “In addition, the sentence has been very well founded by the court,” he remarked.
