A painful accident happened late in the evening of the fateful Wednesday in Kaunas back in the fall of 2018. A worker was fatally injured while unloading the cargo from the tractor.
On November 21 at around 10:30 p.m. in Kaunas Europos Avenue, when unloading metal from the tractor pipes-rods, they began to fall.
The falling pipes crushed and fatally injured the worker-loader of the company who was standing nearby, born in 1974, announced to the public six and a half years ago in a laconic statement of the Police Department.
At the height of the event, not all the circumstances were clear, but then no one might have predicted that the disputes over the worker’s death would drag on for more than five years and even require clarification by the Supreme Court.
Aspects related to the accident were investigated in different but related cases – criminal and civil.
The criminal process that has taken place, judging by its duration and the costs of other resources, can be called simpler.
At that time, the panel of three judges of the Supreme Court of Lithuania had to work on the final assessment of the situation according to the principles provided by the Civil Code.
The judges of the elite rank gave a reasoned answer: not only those who were directly responsible for the safety of employees should open the wallet.
