The Luxembourg parliament on Wednesday gave the green light for the cultivation and recreational consumption of cannabis in the private sphere. Each household will thus be able to have four plants, as long as they are not visible from the outside. Public use remains prohibited.
The law was passed by 38 votes for and 22 once morest. Its advocates hope the measure will reduce drug trafficking. In addition, it must protect consumers once morest adulterated cannabis.
“The drug policy we have had for 50 years already is a failure,” Justice Minister Sam Tanson of the Greens told the House of Representatives.
Towards a sale controlled by the State
The more lenient approach to private use should only be a first step. “The second stage is the development of state-controlled production chains and state-controlled cannabis sales,” explains Josée Lorsché, of the Greens. Thus, Luxembourg will be able to monitor the quality of cannabis and the quantity of its active ingredient, tetrahydrocannabinol.
Those who are caught consuming cannabis in public space risk a fine of 25 to 500 euros. For possession of more than 3 grams, offenders are liable to legal proceedings with a maximum penalty of 6 months in prison or a fine of 2,500 euros.
The law, proposed by the Social Democratic government coalition, was strongly criticized by the opposition. According to Gilles Roth of the popular Christian-social party CSV/PSC, the law will miss its target. “Luxembourg violates international treaties with this law,” he says.
