A significant cost for a “joke” in very poor taste. And faced with the proliferation of these false bomb alerts since the October 16 attack in Brussels, several questions arise: do we really have the means to investigate these authors of false bomb alerts? And how can we find them?

In terms of the law, these facts are obviously punishable. And it is good to remember what the author of such a hoax incurs. Contacted, the FPS Justice specifies: “On the basis of article 328 of the Penal Code, false bomb threats are punishable by imprisonment ranging from 3 months to two years and/or fines ranging from 400 to 3,200 euros (taking into account additional decimes , i.e. times 8). It should be noted that the procedural costs must be added to this, which will be borne by the convicted person. In addition, an intervention in the costs linked to interventions by firefighters, civil protection, deminers, etc. will generally be requested.“.

A criminal sanction, but the penalty may be even heavier in civil: “These are all the costs that are caused by having to call on special services, tracking dogs for the evacuation of people, all the inconvenience that this causes“, adds Julie Baiwy, spokesperson for the Mons public prosecutor’s office. “Et therefore, in addition to criminal sentences of imprisonment and a fine, there may be civil reparations which can go very high in the figures.”

If the perpetrator is a minor, we no longer speak of punishment but rather of measures. “For example, for the minor who committed the acts in La Louvière, we contacted a youth judge who can take a whole series of measures. It is more of a measure that we put in place to help the young person develop well rather than a punishment. They can be very diverse.

Julie Baiwy adds: “One of the sanctions may be to have the young person followed by a psychologist. Or to have mobile teams with educators who go to the family to reframe them a little, make them respect their limits, make them bear the frustrations. These can also be benefit measures. It’s a bit like the work sentence, but it’s educational benefits for young people to perform. The most restrictive measure is placement in IPPJ“.

Sometimes it takes a little time, but identifying them can still be done.
