The Commissioner of the subcommittee: “Law, Justice and Liberties” at the current Inclusive National Dialogue (DNI), Jean de Dieu Moukagni Iwangou, indicated Friday April 19, 2024 in a brief interview granted to Gabonactu.com, that all the participants in the debates noted the independence of the judiciary to consolidate the democracy still in its infancy in Gabon.
“The trends are pretty good. We were faced with a problem that is quite delicate and we took our responsibilities in the clearest possible manner. The Head of State is the father of the Nation, as such, he is the President of the Republic and the Head of the Executive. Parliament, depending on the dimension given to it, must play its role and the judiciary must be independent. Things are clear like that”explained Mr. Moukagni Iwangou
For the former Minister of Ali Bongo, also a lawyer by training, of this postulate, the Head of State will no longer be the president of the Superior Council of the Judiciary (CSM). Because it will no longer be able to “guarantee the independence of magistrates because magistrates are a body, they must be able to defend themselves”.
“We will have the separation of powers, because they must be separated and independent of each other: Montesquieu and John Locke testified to this truth and we will try to apply it,” he argued.
