In a decree published this Sunday in the official journal, the government affirmed its desire for employers to declare the fatal work accidents of their employees more quickly for greater transparency. From now on, a boss will have a maximum of twelve hours following a fatal accident of one of his employees to inform the labor inspectorate.
“Findings that are too late are likely to harm the manifestation of the truth, given the risk of tampering with the evidence”, explains the Ministry of Labor in a press release published on Sunday. The idea is thus to speed up the procedures in order to be able to better determine the conditions of the death of an employee in his workplace.
This twelve-hour period runs from the moment the employer becomes aware of the death of his employee, explains the ministry. Beyond twelve hours following the accident, the employer must prove that he later became aware of the situation before the labor inspectorate. As a reminder, the declaration of an accident at work by an employer is a legal obligation.
Fight once morest hidden work
This measure also includes a section on the fight once morest undeclared work, explains the Ministry of Labor, in particular in the construction sector, very concerned by accidents at work. The objective is to fight “ once morest concealed work which is itself a factor in the occurrence of accidents at work”.
We must “reduce fatal work accidents and develop all useful means to fight once morest illegal work. […] Our goal of full employment goes hand in hand with the need for good employment,” commented Olivier Dussopt, Minister of Labour.
Concretely, companies holding a building permit will have to display their name, company name and address clearly at the site of the construction site and for the public, with a QR code that all passers-by can scan. Thus, if ever a person witnesses a work accident on a construction site, all he has to do is scan the QR code to obtain the employer’s information.
