The government approves the decree that regulates the recharging points of electric cars

The Council of Ministers has approved this Tuesday a royal decree that regulates the activity of providing recharging of electric vehicleswith obligations and rights of the agents participating in the activity, such as the submission of information on the characteristics of the facilities to prepare an official map of recharging points that will be made public “in the coming months”.

The document was created with the aim of completing the applicable regulatory framework for electric vehicle charging activity, in order to boost sustainable mobility and achieve the goal of 100,000 public charging points in 2023.

In the press conference following the Council of Ministers, Minister Teresa Ribera pointed out that the approved royal decree aims to “consolidate the reliability of recharging infrastructures” and has detailed that the objective is that by the end of 2023 there will be 100,000 charging points. electrical charging for vehicles.

In this sense, the minister has underlined that “the obligations to which those who install a recharging point in a public space are subject to, including those of important information to map and know the availability of each recharging point or the price of recharging in each of the facilities on public roads«.

In addition, the document contemplates that the operators and suppliers must send the Ministry, the autonomous communities and Ceuta and Melilla, the necessary information to publish an official map of charging points indicating the location, characteristics and price of the recharge, among other data.

The Government will regulate, through a ministerial order currently being processed, the information to be sent by these parties.

The Ministry of Ecological Transition and Demographic Challenge indicated that it is developing an “incentive” regulatory framework for the deployment of recharging points, which is materialized with financial aid from the Recovery, Transformation and Resilience Plan.

Legal Figures

This rule establishes two legal figures that can participate in the recharging activity of electric vehicles. The first is the operator of the recharging point, which is the owner of the exploitation rights of the stations and responsible for its physical operations.

The second figure is the service provider company for electric mobility, which acts as an intermediary between operators and users of electric cars, which can provide value-added services to said users.

This regulation only affects public access recharging points, establishing the rights and obligations of operators and service providers with the aim of facilitating recharging and reinforcing user protection.

Thus, the two actors must report the origin of the electrical energy supplied, at the same time that they must have a customer service and must preserve the confidential nature of the information of which they become aware in the performance of their activity.

This royal decree reinforces the obligation of punctual recharging in public access stations, “without the possibility of establishing barriers of a technical or contractual nature, gguaranteeing access for all users of electric vehicles to recharging and reducing the so-called ‘range anxiety’«.
