The Constitutional Council was seized by the two parliamentary chambers on the vaccination pass: the Assembly then the Senate, led respectively by the parliamentary groups of insubordinate France and the Socialists, brought together the number of parliamentarians necessary (sixty) for their referral .

It is through a “narrow door”, an expression designating an “external contribution” to the Council’s deliberations, that the Right & Freedom Circle also showed up. The text “deals with the unconstitutionality of the vaccination pass and the identity check created by the bill adopted on January 16, 2022”, specifies the Cercle, which wished to focus its contribution on a few key points, and details in eight pages its arguments, arranged as follows:

1. Lack of suitability for the constitutional objective of protecting public health
2. A vaccination obligation not provided for by law
3. Disproportionate infringement of the principle of equality
4. A breach of the principle of equality
