Do the approximately 13 billion dollars that Microsoft has promised to invest in OpenAI, the famous start-up behind ChatGPT, constitute a de facto acquisition? After the British competition watchdog in December, the European Commission will in turn look into the subject. This Tuesday, Brussels announced that it would “verify” whether Microsoft’s investment in OpenAI might be assessed under European law on mergers and acquisitions.

This examination is the first step before opening a potential investigation, although at this stage it is not certain that Brussels will go that far. But Europe is vigilant, while the continent was the first in the world to regulate artificial intelligence by adopting the AI ​​Act at the end of 2023. The announcement also comes as Margrethe Vestager, the executive vice-president of the Commission responsible for competition, is visiting California this week, where she is due to meet several tech giants.
