The government published this Sunday, in the Official Journal, implementing decrees for the pension reform which should put an end to the main special schemes from September.
The government published Sunday in the Official Journal the implementing decrees for the abolition of the main special pension schemes (RATP, electricity and gas industries, notary clerks and Banque de France), provided for by the pension reform. These schemes will be abolished for agents recruited from September 2023.
Agents recruited previously continue to benefit from these schemes (“grandfather clause”), but they are not exempt from the changes provided for by the reform for all employees. Thus, for these agents, “the age of opening of rights is gradually raised by 2 years” and “the duration of insurance required for the full rate sees its increase in charge accelerated”, recalled the Ministry of Labor in a communicated.
“These developments will start to take effect from January 1, 2025, the date from which the convergence measures of the previous reforms have finished their ramp-up”, he added. However, the ages for canceling the discount in the RATP and electricity and gas industry regimes “remain unchanged”, recalls the ministry.
Regimes will survive
The long career scheme is adapted for these schemes in the same way as for the general scheme, with four age limits for entry into the scheme (16 years, 18 years, 20 years and 21 years), authorizing a departure early retirement “according to four limits of opening of rights”, at 58, 60, 62 or 63 years respectively.
In accordance with the provisions of the reform, “the period of contributory insurance necessary to benefit from this device is now reduced to that required to obtain the full rate”.
And “the personal commitment of caregivers (in family life: editor’s note) is recognized, since four quarters granted in this respect can now be taken into account for the benefit of this device”.
The date of entry into force of the pension reform is September 1, 2023. The government must publish the bulk of the implementing texts before this date.
Certain regimes which respond to “specific constraints” continue to exist following the reform (sailors, Paris Opera, Comédie Française). The autonomous regimes (liberal professions and lawyers) are not affected either.
