“The Death of Simon Bachelet: Seeking Justice for a Tragic LSD Overdose”

2023-05-22 16:15:00

On July 16, 2016, a storm raged in the Dordogne sky. The Bachelet family learns that one of their three sons, Simon, has just died at the age of 26. The engineer from the Decathlon company, who had just developed a product on which he presented his muscles sculpted by sport, was camping at the Dour festival, a few kilometers from Lille where he lived, with a few friends. That day, he consumes a toxic substance, LSD, sold by a young man from Dourois.

A few minutes later, Simon was sent to a drunk tank for disturbing public order, after being taken care of by the Red Cross. He is naked in his cell. He bangs his head against the wall, he screams, he seems to be in very bad shape. He dies in hospital. Since that sinister day, his family has been waiting for a judicial truth. The public prosecutor had requested a dismissal before the council chamber. Mr. Mainz insisted and the indictment chamber considered that there should be a trial. It took place on Monday.

The dealer disputes the causal link

Who is responsible for his death? The young man who gave him the drugs?

Yes, according to the prosecution, which requires a sentence of between three and four years. A severity that surprises Me Romain Delcoigne, defense lawyer. “He has a clean criminal record and he complied with the conditions imposed by the investigating judge seven years ago”. The penalist pleads a measure of favor, or a penalty of work.

For the public prosecutor, the causal link between the drug and the death is established. The defense has another reading of the file, since no trace of LSD was found in the blood of the victim. In addition, other people have used this drug, without being sick.

Culpable forbearance

Did the four police officers commit a fault?

Yes, according to Me Jean-Philippe Mayence, lawyer for the civil parties. The lawyer believes that the police should have called a doctor, given the serious danger facing the victim.

No, according to the other parties to the lawsuit. “I don’t think the record establishes that there was a willful refusal to provide assistance”, declares the deputy public prosecutor.

Me Pol Descamps answers no to the question of the non-assistance to person in danger, reproached to his police client. “The Dour festival is the drug festival”, affirms the Mons lawyer. “Coming from the lawyer of someone who’s supposed to uphold the law, that’s kind of surprising.”, replies the president Laurent Schretter.

Me Frank Discepoli, lawyer for a commissioner qualified as competent by his hierarchy, also pleads his acquittal. That day, she was in reinforcement throughout the area, and not just at the festival. “To hear that she has decided not to do anything, facing a man who is dying, it’s hard […] Before her appearance before the indictment chamber, she had never seen these videos! The shock was enormous for her, who was never charged in connection with this case. ”

Finally, Me Eric Soccio, also pleaded for the acquittal of another police commissioner, sharing the position of his colleague.

Judgment will be pronounced within a month.
