The preparatory hearing of the case will be held remotely on Thursday morning, court representative Lina Nemeikaitė reported to BNS.
The case material is recognized as non-public, so it will be examined in closed sessions.
Dovilė Armalytė, associate partner of TGS Baltic law firm, representing BaltCap companies, says that for now the case is being examined according to the original lawsuit dated December 12, 2023, and after receiving all the information, which will be decided at the first hearing, the plaintiffs will submit a revised lawsuit, in which , among other things, the amount requested and the composition of the parties to the proceedings will be clarified by including the plaintiff and Poland’s EN Efficiency.
“The preliminary hearing will deal with the requests previously submitted by the parties in the procedural documents, mainly regarding the demand for additional evidence and information (…). We hope for a smooth process and ultimately a successful outcome of the case”, said D. Armalytė in a comment to BNS.
The case will be examined after the Selection Panel of the Supreme Court of Lithuania (LAT) on August 28 and again on September 24 refused to accept the cassation appeal of “OB Holding 1” regarding the revision of the Court of Appeal’s ruling of June 13.
The Court of Appeal ruled in June that the lawsuit of BaltCap companies regarding Š. The return of Stepukonis’ lost millions must be examined in Lithuania.
The company wanted it to be examined in Estonia.
BaltCap companies Žvirgždaičių energija, Nullus and Moelta filed a million-dollar claim to the court last December – they request from Š. Stepukonis and “Olympic Casino” and “OB Holding 1” returned 26 million. financial assets worth EUR and to compensate for the damage.
In the previous ruling of the Court of Appeal, passed in April, it is written that Š. Stepukonis had transferred 31.6 million to the account of “OB Holding 1” in Lithuania. euros.
Another lawsuit by BaltCap companies – Š. For Stepukonis and the US securities trading platform “Interactive Brokers Central Europe” operating in Hungary, the Vilnius District Court, LAT will start hearing on October 24 after the final decision on the issue of jurisdiction. Meetings will also take place behind closed doors.
Sh. Stepukonis is under pretrial detention – in September, the court extended his intensive care for another three months – until December 20 – a collar is placed on him, and communication with certain persons is prohibited.
A former partner of the BaltCap fund is suspected of illegally embezzling at least 27 million. euros from the fund’s companies, but according to prosecutors, this amount may increase. According to BaltCap representatives, about 40 million could have disappeared from the fund’s companies. euros.
It is suspected that most of the embezzled money Š. Stepukonis lost.
