the Council of State dismisses Orange

The Council of State rejected the priority question of constitutionality (QPC), filed in early February by the telecom group Orange against the telecom regulator (Arcep), about fiber in medium-sized towns.

In March 2022, Arcep had given notice to the telecom operator to respect, by the end of September 2022, its commitments to the government, i.e. to cover 100% of the premises in moderately dense areas of the territory. (called Amii zones). Orange had then filed a QPC, requesting the cancellation of this formal notice, which suspended the procedure.

War is declared between Orange and Arcep

Arcep did not appreciate Orange’s initiative at the time, declaring that the operator was also attacking the government and local communities.

“These national commitments have been achieved, and even exceeded, with 12.1 million households made connectable by the end of 2022, while the ambition was increased to 10.89 million housing units”Orange said last February.
