On Wednesday, April 19, 2023, the web was flooded with the news of the rejection of the request for provisional release of the advisers of Mohamed Youssouf Bathily, also known as Ras Bath, by the High Court of Commune IV of the district of Bamako, once morest all the expectations of the leaders of the Collective for the Defense of the Republic (CDR). Since March 13, 2023, the columnist has been in pre-trial detention on three counts, following a decision taken by the Premier Cabinet of the Tribunal de Grande Instance of Commune IV in the district of Bamako. Despite this, the CDR remains calm and has confidence in the Malian justice system.
According to some jurists, any person, Malian or foreign, charged or accused, can request provisional release in any case. This request may be granted either by the investigating judge, or at the request of the public prosecutor, or ex officio, because it is motivated by elements of assessment on the part of the judge in charge of the case.
Some political observers expected the rejection of the request for provisional release from the Tribunal de Grande Instance of Commune IV of the district of Bamako, because the recent exit of the advisers of Mohamed Youssouf Bathily in Paris has irritated many magistrates and certainly played a role in the court’s decision.
In short, Mohamed Youssouf Bathily remains in prison for the moment, despite the rejected request for provisional release. The CDR remains confident regarding the outcome of this case and continues to trust Malian justice.
