The Central Register of Management Bans: Ensuring Justice for Entrepreneurs and Victims

The Central Register of management bans has been accessible to the public since October 20 via “JustBan”, a new application from Just-on-web, the digital portal of Justice, indicated Sunday the Minister of Justice, Paul Van Tigchelt, in a press release.

In the context of bankruptcy, judges can impose a ban on management. This happens when a contractor has made gross errors or failed fraudulently. However, fraudulent contractors, for example in the construction sector, still often manage to claim new victims. This is explained, among other things, because they manage to stay under the radar easily.

The new central register of management bans, an initiative of the former Minister of Justice, Vincent Van Quickenborne, aims to bring change at this level. It is possible to connect to the platform via Itsme or with your identity card. Notaries and the police can also observe the register.

The register was adopted in the House in April. For the moment, only the bans on management in force pronounced in Belgium on a criminal level are published, for example for acts of fraud, forgery or embezzlement of funds. In a second phase, management bans linked to a civil decision will be added, those pronounced by a judge of the company court, for example in the context of poor management in the run-up to bankruptcy. This phase is planned for spring 2024.

“Management bans too often remain a dead letter because they are not sufficiently controlled. As a result, dishonest entrepreneurs and fraudulent administrators can often continue to make victims,” said Mr. Van Tigchelt (Open Vld) , quoted in the press release. “It had to stop.”
