The CC will learn of Tedefe’s withdrawal, which might be key to ending the suspension

The Magistrates of the Constitutional Court (CC) will hear on Wednesday the withdrawal of the Federated Sports Court (Tedefe) on the statutes of the Guatemalan Olympic Committee (COG).

According to one source, The CC scheduled for Wednesday to hear regarding the withdrawal presented by Tedefe on April 14, 2023which will be decisive for the IOC to lift the suspension of Olympic sport.

The magistrates who supported programming the unconstitutionality are Dina Ochoa, Roberto Molina Barreto and the substitutes Claudia Paniagua and Rony López.

For almost a year, the CC had neglected to know and resolve the withdrawal, requested by the members of the Tedefe Carlos Salvador González president; María Alejandra Álvarez, vice president; and Jorge Mario Ramírez, secretary.

Tedefe has blamed “the former members of this Court for the unconstitutionality actions identified with the accumulated file numbers 3113-2022 and 3275-2022 presented to the Constitutional Court, without having had the legitimation and legal argument for their promotion.

The articles that the CC suspended at the time, in an action by the previous Tedefe, were andl i) articles 13 literals c), d) ye), 15, 16, 17 literals a), j) yk), 19, 22 literals b) yf), 23 literals c) yd), 24, 28, 29, and 32 literal a).

The last few days have been decisive in Olympic sport, especially following the Assembly of the Guatemalan Olympic Committee learned of the Tedefe resolution, that declared the election of Jorge Rodas as illegal, and unanimously resolved to disown the former soccer player, at the same time confirming Gerardo Aguirre as president of COG.

Guatemala was suspended by the IOC on October 15, 2022, following the CC did not resolve to lift the COG statutes and during that time a series of legal actions have been carried out that have kept the problem trapped.
