federal judge Gustavo Villanueva sent this Friday to the Federal Oral Court of Roca the causes for the usurpation of state and private lands of Villa Mascardi. One of the files is that of the Mapuche women who are under house arrest following they were arrested, on October 4, during the final eviction of the properties.
Betiana Colhuan Nahuel, Romina Rosas, María Celeste Ardaiz and Marta Jaramillo They are serving house arrest in a house in the Lomas de Villaverde neighborhood, in the eastern part of Bariloche, very close to the city center. They were arrested by order of Silvina Domínguez, a federal judge who is already retired and who, as head of the Zapala court, subrogated in the Andean city.
There is a second case, which has men as defendants (Juan Pablo Colhuan, among them) and which had been separated from that of women, but which, by decision of the Federal Criminal Cassation Chamber, are now unified and elevated to judgment.
The elevation was ordered by the federal judge of Neuquén who subrogates in Bariloche. Also in November 2017, when the first eviction was attempted, Villanueva was there as a replacement. In a subsequent procedure, the Prefecture shot a young man, Rafael Nahuel, who had come to support the community with a shot from behind.
In fact, the case of Juan Pablo Colhuan was already in the Roca court because the trial once morest the women was going to be correctional and therefore would be in charge of Judge Villanueva, but Casación, by unifying the cases, left that file to The instruction.
Agreement but also judgment
The case goes to the court that must carry out the oral trial the next day of the agreement signed by members of the Mapuche community created in 2017, when they occupied a National Park property in Villa Mascardi, with the national government to recognize a part of those lands for settlement of that group and development of spiritual aspects.
Betiana Colhuan Nahuel, Romina Rosas, María Celeste Ardaiz and Marta Jaramillo were initially housed in the Bariloche airport and two days later, transferred to a women’s prison in Ezeiza, in Greater Buenos Aires. Judge Domínguez’s decision aroused a wave of criticism and in a matter of days they returned to Bariloche to serve house arrest. That was last October 9.
