In the light of the delays and damages registered in the PASO with the electronic voting systemthe Government of the city of Buenos Aires arranged through a decree that the October elections will be held in Buenos Aires with paper ballots both for national positions and for local categories.

The recent modification was defined a few days after the severe note directed by the judge Maria Servini to the Buenos Aires authorities of the Electoral Management Institute, in which he argued that re-implementing the Single Electronic Ballot devices in October would be “a mockery of the citizenry” by “resubjecting her to demeaning conditions.”

By virtue of the foregoing, the Buenos Aires head of government, Horacio Rodriguez Larretadecreed the adherence of the district to the simultaneity regimeprovided for in national law 15,262, to be applied in general elections and also in a possible second round.

In the recitals of the decree it is stated that “given the experience obtained in the PASO, it is considered opportune, in the next general elections to be held this year or in a possible second electoral round, use the voting system provided for in the National Electoral Code“.

Official sources warned the news agency telam that from said accession “the voting system will be determined by the federal judge with electoral competence, although the separate ballot scheme for local authorities will be maintained“.

Article 3 of the document published in an extension of the Official Gazette explains that “the ballots for local authorities they will be separated from the ballots of national authoritieswithout prejudice to the fact that they will be subject to the characteristics established in article 62 and following of the National Electoral Code 19,945″.

The letter in question also resolves that “in order to reaffirm the autonomy of the Autonomous City of Buenos Airesthat the ballot papers of the local authorities are separate from those of the national authorities“.

However, still They did not specify if there will be two ballot boxes in the October electionsas occurred during the electoral day of Sunday, August 13: one for the national positions of President and Deputies and another for the local categories of Head of Government, Legislators and Community Members.

Simultaneously, the National Electoral Chamber (CNE) ratified this Tuesday the decision of annul the use of electronic tickets for the election of authorities of the City of Buenos Aires.

“Keep in mind the circumstances made known by the electoral judge María Servini about the consequences derived from the malfunction of the electronic single ballot voting system“, it was indicated in a letter signed by the president of the CNE Alberto Dalla Vía.

“It should be noted that the shortcomings in the implementation of said voting system were warned by this Courton the occasion of considering the respective collaboration agreement between the national electoral justice system and the local electoral authority, on July 27 of this year,” added the CNE resolution.

In this sense, the decree of the Buenos Aires government would be a response to the decision adopted by Servini when he annulled the Agreement Act signed on June 24, 2023 between his court, the City Electoral Tribunal and the IGE “which prevents the possibility of holding general elections with the Single Electronic Ballot (BUE)”.
