Under military registration laws, Russian banks are obliged to refuse loans to deserters, but they still don’t know how to meet these requirements. As of November 1, 2024, the Ministry of Defense of the Russian Federation must start maintaining a unified register of military records and recording in it data on citizens evading military service. In turn, banks must refuse to enter into credit agreements, including mortgage agreements and deserter loan agreements, from the moment the database is launched. However, according to the NSFR letter, the interaction process between the bank and the Department of Defense has not yet been determined.

The head of the committee explained that the problem of providing banks with military registration registers arose long ago but has not yet been resolved. The Department of Defense objects to providing direct access and insists that banks notify tax evaders of denials of service through the Department of Defense.

“But we still don’t understand how this works: we don’t yet know the transmission channel, the technical parameters of access, the mode of interaction (batch, registration or individual),” Emeling said. Technically, banks may not have time to complete their systems before launching registration systems, he said.

Banks also complain that they have not set rules for how and when they should deny loans to customers if they are found to be tax evaders. As Emelin explains, the biggest fear for market participants is the situation where, when the loan is issued, the customer is not yet designated as a deserter in the register, but when the agreement is registered, for example, Rosreestr, he is already included in the database.

“The client was eventually included in the list of tax evaders and Rosreestr refused to register a mortgage for this person on absolutely legal grounds. It turned out that the bank granted the loan legally and the loan was changed from secured to unsecured. These are the banks Different reserves, different interest rates, different terms,” ​​he explained.

He said banks might only draw one conclusion from the situation – reconsider risk policies related to entire categories of customers. The head of the NSFR noted that if clear rules for banks do not emerge when the register is launched, the most conservative market players will simply deny loans to men of military age or downgrade the approval level of their applications.

Russia passed a law on the establishment of a unified military service register in April 2023. The law involves sending electronic summonses to citizens through the National Service Portal and tightens restrictions on those who receive summonses but fail to show up at military registration and enlistment offices.
