The age requirement of judges in the Constitutional Court may become controversial: Bilawal

Pakistan People’s Party Chairman of Bilawal Bhutto Zardari has said on Tuesday that Proposed constitutional amendment There is no consensus about the age of the judges of the Constitutional Court and other courts.

Addressing the Sindh High Court Bar, Bilawal Bhutto said that ‘as far as the question of the age of judges is concerned, my opinion is similar to yours, of course it is important to create a consensus on it.’

Bilawal Bhutto said that every party has its own position, but the position of my own party is that especially in the constitutional court which is going to be formed, the age requirement of the judges may become controversial.

But the Muslim League-N and other parties have the right to increase the overall age not only for this constitutional court but also for the judges of the Supreme Court and the High Court.

He said that the position of Jamiat Ulama-e-Islam was that the current age should be maintained, but my personal suggestion was that as far as the minimum age limit is concerned, it should be brought up to the original limit of 40 years and as far as the Constitutional Court is concerned, So I think we should not put any age requirement.

Therefore, we came up with an intermediate and impartial solution that as soon as the Constitutional Court is formed, you should use the term of office and do not think of extending the age and you will have to create a consensus for the term of office. Let’s see what is decided about age in the final consensus.’

Chairman People’s Party said that constitution making and legislation cannot be done through the judiciary and under the proposed constitutional amendments, a constitutional court will be formed.

According to Bilawal: ‘Courts cannot make constitutions and laws, the 19th constitutional amendment had to be brought because of the threat of the Supreme Court, but now they will continue to bring judicial reforms according to the charter of democracy.’

He said that through the proposed amendment, the Constitutional Court will be formed and this is necessary so that no other Prime Minister is hanged on the throne in the future.

He said that the 18th Amendment had to change the way of appointing judges which is prevalent all over the world like the Parliament decides to appoint judges in America, that is the reason why martial law has not been imposed there till date.

According to him, ‘We should make such legislation that is in favor of anyone and not against anyone.’

He further said that the formula of ‘judges by the judges and for the judges’ no longer works, but the decision to appoint judges should be taken by the people through their representatives.

According to him: ‘We had to bring the 19th amendment because of the threat of the Supreme Court who said that if the 19th amendment is not done, they will pick up the 18th amendment and throw it away.’

He said that ‘legislation, constitution making cannot be done through the court, today the court has failed to fulfill its responsibility. The constitutional court will be created so that the people can get justice, therefore the constitutional federal court is necessary and mandatory.

He further said that we sacrificed generations for the restoration of democracy so that the people get power and send such representatives to the parliament and their will becomes law.

He further said that ‘I belong to the family, the party that gave the constitution to the country, our history is such that we have seen how the 1973 constitution is blown away with a twitch of an eye and a twitch of the lips. .’

Bilawal Bhutto said that ‘martyr Ms. Benazir Bhutto signed the Charter of Democracy and decided that if we want to restore the system of Pakistan and restore democracy. Therefore, if the problems of the people are still to be solved, agreements like the Charter of Democracy have to be implemented.

Bilawal Bhutto said that the judicial system in Pakistan is broken, thousands of cases are pending in the courts and I had to wait for 45 years to get justice.

He said that if we want our citizens to get immediate justice and there is no difference between any province, then federal constitution is necessary.

He said that every province will have equal representation in the federal court, the chief justice of the federal court will be on rotation and every province will get an opportunity to represent its chief justice.
