Thanks to the court decision, the air in Latvia will become better

The CC stated that laws that may have a significant impact on the environment must be comprehensively assessed, balancing public welfare, environmental and economic interests.

The chairman of the court, Aldis Lavins, commenting on the decision at a press conference, drew special attention to the fact that the verdict has retroactive effect, since the contested rules of the Cabinet of Ministers were canceled from the moment they were adopted. In practice, this means that tree cutting permits issued following these rules will have to be reconsidered.

The Constitutional Court’s explanation is based on the principle that when developing industrial policy directions, a strategic assessment of the impact on the environment is necessary. The court found that when developing the contested norm, several risks that might cause damage to the environment were known. The Cabinet of Ministers partially assessed these risks, concluding that no significant impact on the environment is expected, but the Constitutional Court stated that the actions taken by the government do not indicate a comprehensive assessment.

Shortly following the decision was made public, Agriculture Minister Armand Krause said the ministry would comply with the Constitutional Court decision, which limits the right of private owners to manage and benefit from their property.
