Texas Death Row Inmate Granted Recusal of Judge from Case
A retired Texas judge who was set to preside over an appeal for Robert Roberson, a death row inmate scheduled to be executed, has recused herself from the case.
Recusal Follows a Series of Controversial Decisions
Senior State District Judge Deborah Oakes Evans signed the recusal order on Monday. No specific reason was offered for her decision, leaving attorneys for Roberson in the dark about the sudden change in plans. “I have not yet been served with this order and do not know anything about what prompted Judge Evans to sign this order soon before Thanksgiving,” said Gretchen Sween, one of Roberson’s attorneys.

A History of Involvement and a Last-Minute Change
Evans’ involvement in Roberson’s case began in 2016 when, after his first execution was stayed and the Texas Court of Criminal Appeals sent his case back to the trial court, she oversaw Roberson’s legal challenge. After a nine-day hearing, Evans recommended that all relief be denied. She later retired from the bench in 2022. But in2024, it was disclosed after the state of Texas sought a new execution date that Evans had been assigned to Roberson’s case, and she set his execution for Oct. 17.
What raised eyebrows even further was the revelation that Evans arranged to be assigned to Roberson’s case – and was assigned – months before the state sought an execution date. However, this fact was not disclosed until after the state formally requested the execution date. Roberson’s attorneys, including Sween, immediately asked for a hearing before Evans, but their requests were denied.
Concerns Raised Over Evans’ Impartiality
On Sept. 25, Roberson’s legal team filed a motion asking for the execution warrant to be set aside and requesting that Evans voluntarily recuse herself from the case. In their filings, defense attorneys cited the “opaque process” of Evans’ sudden return after retirement to breathe new life into this case.
They also highlighted the “deep personal relationships” the judge has with several key figures connected to the case, raising serious concerns about her impartiality. These figures included the original prosecutor in Roberson’s case, the judge who terminated his parental rights, and the current Anderson County district attorney, who had actively opposed Roberson’s habeas relief.
“After carefully reviewing all the facts and considering all sides, Judge Evans has determined that she should recuse herself from the case,” Sween stated.
