A Texas internal medicine doctor has been convicted of accepting over $200,000 in kickbacks for funneling patient samples to designated laboratories, an alarming revelation reported by officials from the U.S. Attorney for the Northern District of Texas.

Dr. Hector Ubaldo, aged 60, was formally indicted in September. Following a two-day trial, a federal grand jury swiftly reached a verdict, taking just 14 minutes to convict him of conspiracy to pay and receive healthcare kickbacks, as well as solicitation and acceptance of illegal kickbacks.

Evidence presented during the trial suggested that Ubaldo received cash payments from various “marketers” in exchange for directing blood and urine samples from patients to specified laboratories, which subsequently submitted bills to insurance companies and Medicare for diagnostic testing services, according to a news release from the U.S. Attorney’s Office.

Ubaldo was found to have engaged in “sham medical advisory agreements with the labs and marketers,” where he was nominally contracted to provide advisory services in exchange for a monthly fee. However, the evidence showed that these services were neither needed by the labs and marketers nor actually provided by Ubaldo.

“Instead, the medical advisory service agreements served as a fraudulent vehicle to funnel kickback payments to Dr. Ubaldo in exchange for his sending samples to specific labs,” the U.S. Attorney’s Office stated, highlighting the deceptive nature of these arrangements.

On multiple occasions, one of the marketers was recorded meeting with Ubaldo at his office, where he handed over significant amounts of cash. Video evidence capturing these illicit transactions was presented in court. During one of these meetings, Dr. Ubaldo candidly admitted, “To tell you the truth, I need the cash,” showcasing the motivations behind his illegal activities.

In total, Ubaldo accepted more than $253,000 in bribes, as per the findings of the U.S. Attorney’s Office. He now faces a potential sentence of up to 15 years in federal prison and has been taken into custody while awaiting sentencing.
