Austin ∙ Texas Attorney General Ken Paxton filed a lawsuit once morest the Biden administration. The federal government is accused of illegally destroying state property. The lawsuit alleges that federal authorities cut concertino razor fencing erected by the Texas state government along the Rio Grande River along the US-Mexico border.
Paxton was recently acquitted in an impeachment trial by the state House of Representatives. Paxton filed the lawsuit once morest the Fed in the Western District of Texas. The suit alleges that because the wires are cut, Texas is unable to effectively prevent illegal immigrants from entering the state.
In a special session of the Texas Legislature, lawmakers are debating various security measures along the state’s borders. Texas is litigating another border issue with the federal government.
In a written statement, Paxton said Texas has the authority to create border defenses. A spokesman for the Department of Homeland Security said it might not comment on the case because it is ongoing.
A spokeswoman said Border Security Patrol agents have all the authority under federal law to detain intruders without prior authorization and to take appropriate action if they believe U.S. employees pose a threat.
Travis Considine, a spokesman for the Department of Public Safety, declined to comment on the case. Texas Gov. Greg Abbott’s office also did not respond. Homeland Security officials previously said they had cut razor-sharp wires that might have drowned in dangerous waters. Customs and Border Protection Department documents said wire fencing hindered agents from doing their jobs. The concertina wire creates problems for agents to stop and take into custody a population passing through dangerous situations. Among the migrants are children and families. There are also children who come in alone. Customs and Border Protection’s internal memo dated June 26, 2023 said.
Border Patrol agents’ removal of barbed-wire fences was controversial last month as illegal immigrants arrived through Eagle Pass in large numbers (thousands) causing major headaches for local, state and federal authorities.
The federal government had filed a lawsuit once morest the Texas government for placing buoys in the Rio Grande River to obstruct immigration. A federal judge ordered the buoys removed in September. The state went to the Court of Appeal once morest this. The appellate court judge expressed displeasure with the attorneys’ argument. But no verdict was issued.
