Firstly, Sandra Liliana Brand participated as ad hoc secretary in several assemblies held by Luket SAS, in 2015 and 2016.
A worker named Ana Isabel Palacios Ortiz, as established by the Transparency Secretariat, was linked to the three companies. In Luket she is the one authorized to carry out procedures before the Pasto Chamber of Commerce, signing as ad hoc secretary in an assembly minute. For Brand, she was ad hoc secretary of several assemblies and, at Impoamericana, Roger is an accountant.

Luis Eduardo López Rosero, legal representative of Luket SAS, signed financial statements of Impoamericana Roger SAS, which were also validated by Ana Isabel Palacios. Then, Roger Pastas, legal representative of the firm that signed the contract with the UNGRD, requested correction from the Cúcuta Chamber of Commerce, saying that it was “a mistake.”
Faced with all this, the Transparency Secretariat senses: “In effect, it might have happened if the accountant worked the same format for both companies and forgot to modify the name of the representative. However, it is clear that there is a link between the two companies and their staff.”
At the same time, José Alberto Sotelo Paz served as tax auditor for both Luket SAS and Brand SAS.
In addition, Luis Eduardo López Rosero was legal representative of RML Constructora SAS and Proyectos RML SAS, a company in which Luket SAS is a shareholder. The substitute legal representative of the last company is Roger Alexander Pastas and Jorge Alberto Sotelo was also tax auditor of this in 2018.
Among the findings, the Transparency Secretariat found that companies have description codes for common economic activities, with almost identical social objects.
In addition, the Transparency Secretariat managed to establish that Sandra Liliana Brand is the wife of López Rosero, Luket’s legal representative.
“If you have five companies and you have a quote to all five companies, it is very possible that, within the framework of what might be determined as a violation of competition, prices might have been established artificially in order to be able to keep better ones. values for the acquisition, in this case, of the tank cars. In practice, the values would have risen in a quote,” he stated.
