“Unfortunately current events repeat something that has already happened in the past and risks becoming a sort of farce when it is repeated. The Rome court will be called upon again to judge on this topic, it has already expressed its opinion previously and the general interpretative guidelines I think they have been rather outlined. I would be surprised if anything changed”, said the secretary of the Democratic Judiciary, Stefano Musolino, on the sidelines of the two-day event organized in the Capitol for the sixtieth anniversary of the organisation, answering reporters’ questions regarding what the court will decide on the issue relating to the eight migrants transported on the second voyage to Albania by the Libra ship and the new remote controversies with the government. “There have been various jurisprudential orientations so far, all based on the assumption of the superiority of the European law”, adds Musolino, who believes that the most likely thing is either an appeal to the European Court or the non-application of the law directly. Precisely for this reason, according to the magistrate “there is a unanimous chorus on this thing among all those who have studied the subject”, who not surprisingly “are all oriented in this direction”. Musolino then also focuses attention on another fact: “Certainly the technical times to resolve this issue prevent detention beyond the terms established by law”, meaning that, once the 28 days foreseen have expired, the eight migrants will have to return to Italy waiting for a definitive answer.
