New Delhi: IAS officer Shah Faisal and former JNU student leader Shehla Rasheed have withdrawn the petitions filed in the Supreme Court once morest the abrogation of Article 370 of the Constitution, which gives special status to Jammu and Kashmir. Chief Justice D.Y. A five-judge constitution bench headed by Chandrachud allowed both to withdraw their pleas.
The court also ordered to remove their names from the list of complainants. Shah Faisal is the topper in Civil Service Exam 2009. He is also the first native of Kashmir to achieve this feat. Shah, who served in various departments, unexpectedly retired from service in 2019 in protest once morest the attacks in Kashmir.
He later posted a note on Facebook accusing the Center of marginalizing Indian Muslims and subverting government institutions. A political party was also formed by the name of Jammu and Kashmir People’s Movement. Shehla Rasheed was a student union leader at Jawaharlal Nehru University. They worked closely with Shah Faisal’s party. Later both of them left the party. Meanwhile, Shah Faisal was taken back into service.
The Constitution Bench of the Supreme Court will hear the petitions once morest the abrogation of Article 370 from August 2. It is the first time since March 2020 that the petitions have been considered. On August 5, 2019, the central government abrogated Articles 370 and 35A of the Constitution. The Center had also introduced a law to make Jammu and Kashmir and Ladakh into separate Union Territories. About 20 petitions are before the Supreme Court questioning these.
