New Delhi: The Supreme Court has granted interim protection to social activist Teesta Setalvad, who was today denied bail by the Gujarat High Court in the 2002 Gujarat genocide case. The Gujarat High Court rejected the bail plea and demanded immediate surrender. Then Teesta Setalwad approached the Supreme Court. A three-member bench comprising Justices BR Gavai, AS Bopanna and Dipankar Dutta held a special sitting at 9:30 tonight and stayed the Gujarat High Court order for seven days. The Supreme Court also criticized the single bench order which did not provide interim protection for even a week. During the delivery of the judgment, the Supreme Court remarked that it regretted to say that the judge’s decision was completely wrong. The Solicitor General argued that this is not an ordinary case and the country and the state have been humiliated for decades, but the court did not agree. Their behavior may be reprehensible. But today the question was whether a person’s freedom should be taken away even for a day. The court also asked what is the urgency in taking them into custody even though they have been on bail for 10 months. Will the sky fall if interim protection is provided? We are shocked by the action of the High Court. The Supreme Court asked what constitutes dire emergency. In the evening, a two-judge bench of the Supreme Court comprising Justices Abhay S. Oka and Prashant Kumar Mishra had noted differences in granting interim protection to her and directed the matter to be referred to a larger bench.
