“Supreme Court dismisses Kerala government’s appeal in Arikomban Mission case”

New Delhi: The state government has faced a heavy blow in the Supreme Court in Arikomban Mission. The Supreme Court dismissed the state government’s appeal once morest the High Court’s order to transfer him to Parambikulam. The Supreme Court of Kerala rejected Kerala’s appeal stating that it would not interfere with the recommendation of the expert committee.

Following the request of the state government, the bench headed by Chief Justice DY Chandrachud considered the petition in the Arikomban matter urgently. The advocates of the state government argued in the Supreme Court that Arikomban is a nuisance elephant and therefore should be allowed to capture it by drugging it and cage it.

The state government also argued in the Supreme Court that it was not practical to shift the violent elephant, which was scrambling for rice, to paddy ponds. But the Supreme Court pointed out that the decision to shift the elephant to Parambikulam was that of the expert committee. The Chief Justice said that this recommendation was given by an expert committee consisting of senior government officials. The Supreme Court rejected the petition stating that it would not interfere in it.

This made the government liable to implement the High Court order to shift Arikomban to Parambikulam. If the order is not implemented, contempt of court action may be taken once morest the officials.

Another petition in support of the state government’s stand on the rice paddy issue has also come up for consideration by the Supreme Court. The Chief Justice has allowed the petition to be heard urgently before the bench tomorrow. But legal experts point out that the court will not change the position once taken.
