A victory that can change everything? On Wednesday January 10, 2024, a student won her case once morest the Paris town hall which had sued her over the subletting of her accommodation on Airbnb.

Our colleagues from Figaro who report this affair recall that it is impossible to rent your accommodation for more than 120 days per year in towns with 120,000 inhabitants. However, this is what this student did, with the agreement of her owner.
Very committed to the fight once morest short-term rentals, the Paris town hall then decided to attack the young woman and ask him for 20,000 euros. But the student’s lawyer managed to take advantage of the three exceptions put in place by law to win the case. Indeed, for “a professional obligation” (on French soil), a “health reason” or a “case of force majeure”, it is possible to rent for more than 120 days on Airbnb, explains Le Figaro.
To order Paris town hall to pay compensation of 2,000 euros, the lawyer relied on the first point. The student did two internships during his school career : a first in the Netherlands in 2019 and a second in England in 2020. Professional reasons, which were however not carried out on the ground, as provided for by law.
However, these arguments were not accepted by the Paris court. The latter estimates that “the professional activities of Madam required her to move away from her home for more than 120 days during the year 2019. The temporary nature of professional imperatives excludes any transfer of main residence”, explained the administration judicial in its judgment, relayed by Le Figaro.
