calls Mauro D’Attis, Forza Italia deputy and vice-president of the Anti-Mafia Commission, when the agencies have just broken a piece of news that is worth thinking about. Roberto Scarpinato, former magistrate, Senator of the 5 Star Movement and also a member of the Commission, asked the President of the organization Chiara Colosimo to return to the Caltanissetta Prosecutor’s Office the documents which concern, among other elements, the interceptions of a conversation between him and Gioacchino Natoli. The latter is a former magistrate, under investigation for alleged aiding and abetting the mafia in part of the “mafia-procurement” investigation.
What does this story teach?
«It is a very serious matter. In the President’s office I observed that it was as if they were saying to the Caltanissetta Prosecutor’s Office: “you made a mistake in sending the papers”.
Where would be the mistake?
«The theory is that the investigations are still ongoing. But it would not be the first case of transmission of documents by the Prosecutor’s Office to the Anti-Mafia Commission when the investigations are still ongoing. It is not clear why, precisely in these investigations, in which in a certain sense Scarpinato is interested, even if not involved in the investigation, the documents should not be transmitted. In any case, these are not assessments that are the responsibility of the Anti-Mafia Commission. The latter, in fact, receives the cards. If anything, it is the prosecutor’s office that has to do it. Furthermore, even more serious is the accusation made by the 5 Star Movement in recent days of a dossier against Scarpinato which according to them originated from the Commission. A not so veiled accusation against the center-right. But the documents weren’t even filed! They were received and registered, but none of us had the opportunity to read them.”
This story has a common thread with that of Federico Cafiero De Raho, current vice president of the Commission and also of the 5 Star Movement. The Five Star Movement has always been for transparency, for the “couldn’t not have known”, for the sacredness of judicial documents. Have they changed their minds?
«We are at a paradox… to make a joke, in the 5 Star Movement they have become extremists of guaranteeism and make even us in Forza Italia pale. It’s not that they are against the publication of the procedural papers, they go further, they really don’t want them to reach the Commission! However, getting serious, this Scarpinato affair creates a condition in the Commission that goes far beyond embarrassment. If you intervene by saying that the documents must be returned, you are evidently exerting influence. And that’s not good.”
In the context of their respective events, would there be the possibility for the Commission to audit De Raho and Scarpinato for the facts that concern them, even if they are members?
«This possibility does not exist at the moment. However, President Colosimo has proposed a law establishing the Anti-Mafia Commission to establish the so-called obligation of abstention for those interested – which we have also invoked several times – to participate in the events that concern them. Today we talk about De Raho and Scarpinato, but the principle can one day be applied to anyone.”
How much guidance are Lucia Borsellino’s words on the right to truth and the memory of her father’s loneliness in the Palermo prosecutor’s office in the weeks before he was killed in via D’Amelio?
«We have always given great importance to the words of Lucia Borsellino and her husband. In this legislature, this Anti-Mafia Commission has contributed to bringing the Via D’Amelio massacre back to the foreground and the reopening of the Caltanissetta investigation shows that the truth still needs to be sought.”
