The National Committee of State Finance Secretaries (Comsefaz) removed from the agenda a proposal that foresees an increase to 25% in the ICMS rate within the Conform Remittance program.
According to the organization, the text was supposed to be voted on this Wednesday (13), but it was withdrawn at the request of members of the group. As a result, taxes continue to be 17% on international purchases.
In a note, Comsefaz said:
It is important to highlight that in the event of a decision being taken by Comsefaz on another occasion, in order to review the current value of the rate, the change will have to be approved by the respective Legislative Assemblies of the 26 states, in addition to the Federal District.
As much as this decline may be celebrated on social media following great repercussion among users, the issue must remain “on the agenda”, since there is a lot of pressure from retailers for the government to charge more taxes in Remessa Conformo.
On another front, trade associations and manufacturers are also seeking to suspend the program in the Federal Supreme Court. The process must be voted on in plenary, but there is still no date for this to happen.

Os states must increase from 17% to 25% the ICMS rate within the Remessa Compliance program. The matter is already being debated within the National Committee of State Finance Secretaries (Comsefaz).
According to sources heard by Estadão, there is a “very favorable climate” for the tax to be readjusted, with the 17% taxation being standardized in June 2023 to facilitate the calculation of ICMS within the federal program.
A technician from the Ministry of Finance said that many states liked the “extra revenue” that Remessa Como has provided, since they have collected a monthly average of R$160 million.
They are happy, they had never received this recipe before.
For the ICMS increase to be implemented, the 27 Legislative Assemblies need to approve the Comsefaz text and this is something that should take some time.
Furthermore, if approved, the new taxation should come into effect in 2025, since the ICMS rule provides that the tax increase can only take effect in the following year.
For now, it is not yet confirmed when the matter will be included in Comsefaz’s agenda, but the measure may please national retailers and the federal government.
This is because the increase in ICMS might make imports more expensive without the Ministry of Finance having to apply a specific rate for purchases below US$50. In practice, the “blame” would fall on the governors and not the federal government.
Even so, technicians say that an exaggerated increase in import taxes might reduce revenue, since Brazilians will stop importing.
