Souad Saleh, nicknamed the Mufti of Women and Jurist of Women, explained, during the first part of her dialogue with the Zainab Stories program broadcast on Youm7 TV, how Sharia dealt with disobedient women, saying: “In contrast to the degree of stewardship, the Qur’an divided women into two parts, the first part being the righteous women. Obedient women who preserve the unseen with what God has preserved, and this woman has no word for the husband. As for the second section, the Qur’an says: “And those whom you fear their disobedience.” So how does the husband deal with the wife in this case, especially with the presence of children, and with the Sharia’s keenness to preserve the family, and here the Sharia has set 3 degrees for dealing, the first is “admonish them”, and if she continues to disobey her, and preaching and talking does not work with her, the second degree comes: and they are abandoned in Beds, and beds are the place of sleep, and abandonment is the interruption of speech, that is, it is not intended for desertion to interrupt it permanently in the house, but only in the place of sleep, and he turns his back on it, and if she is deterred from her disobedience, the third degree, which is “beat them.”

Here, Dr. Souad Saleh stopped at the interpretation of the verse of beating, as some jurists issued a fatwa that beating should be light and not severe using a toothpick or a pencil, but the Al-Azhar jurist disagreed with these interpretations, saying: “Islamic law is the Qur’an and Sunnah, and the Sunnah of the Messenger is actual, verbal and declarative, and the Holy Prophet He did not cancel a text, but he interpreted the text on himself and said: “I am the best of you to his family, and your choice will not be harmed.”

And she explained: “The Messenger did not extend his honorable hand to hit a woman, whether a wife, daughter or mother, even when his wives allied with him and demanded an increase in alimony, including the daughter of Abu Bakr and the daughter of Omar, so he sat sad and did not say anything to them, and when Abu Bakr entered him and asked him regarding the reason for his sadness And he knew what happened when he slapped his daughter Aisha, and said to her: “Do you do that with the Messenger of God?” And so did Omar.

And the women’s jurist went on to say: “Despite the Prophet’s great sadness at their actions, he did not extend his hand to hit one of them, so I do not agree with the principle of beating, and I say that the text in which the word “beat them” is a text suspended from the application because we take the application from the action of the Messenger, and that Our master Omar worked hard and stopped the theft limit in the year of the famine, and he did not cancel the text from the Qur’an, but he found that there are circumstances that require this text to be suspended, and I do not say to delete the text because the Holy Qur’an is unequivocal and conclusive, but I say look at the action of the Messenger, peace and blessings be upon him. with his wives, and we follow the example of the Prophet.”

Souad Saleh explained the issue of a man’s guardianship and linked it to alimony, saying: “In order for a man to have guardianship, he must fulfill his obligations in full in spending on his family and his wife. The woman who works and spends on the family, here the man’s authority and his rights fall, because he did not abide by the right of the woman approved by God,” stressing that the woman in Islam is not responsible for spending at any stage of her life, even if she works, whether she is a daughter, sister, or wife. The man responsible for spending on it is the man, whether he is the father, brother or husband.
