“Social Housing Ownership Checks in Brussels: Rejected Tenants and Legal Regulations”

In the Brussels Region, when the waiting lists for social housing were renewed, 500 candidate tenants were rejected because they were property owners. This is what Secretary of State for Housing Nawal Ben Hamou (PS) answered to a question from Bianca Debaets (CD&V), this Friday in the Brussels parliament. Debaets questioned Ben Hamou regarding ownership checks of foreign property by social tenants following reports that in Flanders half of the social tenants interviewed had been arrested.

Brussels regulations stipulate that a candidate tenant of social housing, or a member of his family, cannot be the owner of a building in full ownership, emphyteusis or usufruct, whether as a dwelling or as a professional purposes. If this is the case, the rental request will be declared null and void or the rental agreement will be terminated.

The Secretary of State recalled that public service real estate companies (SISP) have access to data from the FPS Finances. “Moreover, during the renewal of the files on the waiting lists (for social housing), 500 candidate tenants were rejected because they were owners”, she added. This concerned both buildings in Belgium and abroad.

Bianca Debaets pleaded for controls in the Brussels Region to be reinforced as in Flanders, including the use of private detectives.
