Six complaints filed after incident at school for alleged violation of adolescents’ rights

The Public Prosecutor’s Office (MP) confirmed that there are six complaints being investigated for the possible violation of the rights of some students at a school in Zone 17 of the capital, by allegedly using their photographs and creating pornographic content through Artificial Intelligence (AI).

The investigative body confirmed that on Saturday, August 10, a complaint was filed with the Comprehensive Juvenile Criminal Justice Care Model (MAIJU), which initiated the investigation into the reported events.

“Investigative proceedings were immediately initiated, witness statements were received and comprehensive care was provided to the victims of the crime,” reported Marlon Pacheco, head of the Prosecutor’s Office for Adolescents in Conflict with the Criminal Law.

The MP indicated that the Prosecutor’s Office against Human Trafficking is also intervening and both are looking for evidence to establish the background of the reported events in this case that gained notoriety on social networks, where the first details were released.

In a statement, educational authorities confirmed that a commission is gathering all possible information, and once the evidence is evaluated, the necessary measures will be determined, including recommendations and sanctions for the school.

The Ministry of Education (Mineduc) called for avoiding speculation and stated that its priority is to ensure that the case is handled with “due sensitivity, proportionality, justice and protection for the minors affected.”

The Mineduc administration regretted the events and assured that it will promote actions to recover the “fabric” of the educational community.

The ministry said it will continue to monitor the progress of the case so that appropriate action can be taken.

The events led to a statement on Tuesday, August 13 by the Vice President of the Republic, Karin Herrera, and Danissa Ramírez, head of the Secretariat against Sexual Violence, Exploitation and Human Trafficking (SVET), whose institution also filed a complaint.

Vice President Herrera confirmed that the Ministry of Education follows a protocol for this type of incident, and among other actions, it was announced that the teachers of the school involved will be trained.

Given the current situation, Ramírez also said that both the SVET and other institutions should promote information days for prevention and encourage reporting if there is a suspicion that a crime related to the production, marketing or dissemination of pornographic material involving children or adolescents has been committed.

The Attorney General’s Office (PGN) also issued a statement on August 12 confirming that legal action had been taken and that a multidisciplinary team had been assigned to visit the school on Tuesday, August 13.

Statement from the educational center

Following the situation, the educational center issued a statement on Tuesday, August 13, in which it detailed the actions they carried out after the incident, as well as details of what they know so far about what happened.

According to the school’s position, the school’s educational coordinator was the one who learned of the incident, in which “students misused artificial intelligence tools.”

The school claims that the actions took place outside the school environment, and that the parents were informed of what happened, as well as the National Civil Police (PNC) through a complaint.

The school also indicated that they followed the instructions of the Mineduc to “separate” the alleged perpetrators from the educational community.
