Simplification of the law and ex ante evaluation – Senate

The summary

At the request of the delegation to local authorities, the Comparative Legislation Division carried out a partial update of study no. 267 on the simplification of the law, published in May 2016. This update focuses on the study of ex ante review procedures for draft new regulations in the Netherlands. In addition, it presents initiatives to simplify and reduce administrative charges and costs specifically in favor of local authorities (and not businesses).

The Netherlands is a pioneer and a model in terms of simplifying the law in Europe. Simplification is addressed as a means of reducing the burdens and implementation costs for companies, but also for citizens and local authorities. It is thus a question of reducing the normative pressure (regeldruk) weighing on the various actors.

The success of the Dutch model is due to the existence of two processes for controlling normative pressure:

– at the internal level, the ministries must examine the quality and the necessity of any draft law within the framework of the ex ante evaluation process “IAK”;

– externally, the advisory authority for the control of normative pressure (ATR, formerly known as ACTAL) receives the most important texts.
