Among the main routines of the personnel department are: payroll; vacation control; admission of employees; tax control; labor legislation; shutdown process; benefits; and scoring point. All of these procedures need to be carried out accurately for a company to be up to date with the requirements of the law.

“Bureaucratic issues, such as legal and tax matters, require technical knowledge and concentration. Any slip can result in a possible labor liability, tarnishing the company’s image as an employer and causing financial losses”, warns Marta Corbetta Mazza, director of labor consulting at Econet Editora.

And to help its more than 57,000 customers throughout Brazil correctly conclude all Human Resources operations, Econet Editora created ECORH, a portal that presents the main labor routines related to the personnel department. The tool provides guidance on the entire trajectory of the employment contract, even before its appearance, such as recruitment and selection of candidates, as well as the bureaucratic processes necessary for the admission of the worker and the continuity of the employment contract until its termination.

The portal has tools that help with personnel department calculations, such as Severance Pay Simulators, Overtime, Night Pay, Thirteenth, Vacations, Unemployment Insurance, FGTS and INSS Late Payments. “The tools are precise in calculating the numerous labor payments that must be made in the routine of professionals in the personnel department”, concludes Marta Mazza.

How to formalize the hiring of a new employee

On the ECORH portal there is an exclusive menu entitled employee admission, in which topics such as recruitment and selection, documents required for admission, guidance on medical examinations, employee registration, retention of employee personal documents, conditions for the family allowance and transportation vouchers are dealt with.

“Users can also clarify doubts regarding the peculiarities of hiring a retiree who returns to work or regarding the readmission of employees, for example”, says Marta Mazza.

All these admissions generate an Employment Contract and, before signing it, it is necessary to know the models that can be applied and analyze which ones meet the needs of the company.

In addition, interruptions or suspensions may occur during the course of these contracts. “To solve these doubts, managers find content on paid and unpaid leave, medical certificates and maternity pay at ECORH”, points out Marta Mazza.

As for the breach of contract, the menu termination brings provisions regarding prior notice, additional indemnity, modalities and their severance pay, CTPS – notes including via eSocial, how to proceed with stable employees in the company’s extinction, as well as guidelines regarding the medical examination upon dismissal, unemployment insurance and prescription labor.

Regarding the period of term of contract work, ECORH provides information on accrual of function, entitlement to additional remuneration composition (additional transfer, trust position, tips, for example), as well as the individual employment contract.

“Exclusive content is also made available on the FGTS, contractual and payroll changes, and provisional stability, salary equalization and individual and collective vacations. Usually, all these questions generate many doubts in employers. After all, there are many rules and it is easy to slip in one of them because the Brazilian labor legislation is quite complex”, evaluates the director of Econet.

Absences, holidays and leave

Other predictions that must be observed in the worker’s working hours are: how to proceed in the event of absences from work and public holidays and when it is possible and how to compensate and extend the working hours. In this regard, there are still discussions regarding delays and early departures, including when it is necessary to apply a warning and disciplinary suspension.

Employer obligations

From the moment a company hires an employee, it has to comply with various labor obligations – payment of salary is just one of them. And, in the event of non-compliance, the employer may be liable for labor lawsuits.

In the ECORH employer obligations menu, several tables are available with the analysis of incidents and codes, social security framework, including contributions, payment methods, minimum wage, incidence of taxes and administrative fines.

Finally, in the work inspection menu, it is possible to have access to the contents regarding the labor inspection book, documents that must be presented, assessment and defense, interdictions and embargoes and general rules on labor inspection.
