Because the public prosecutor’s office accused him of having put a total of four kilograms of cocaine into circulation from June 2021 to January 2023, he had to answer at the regional court on Friday. The trial ended with a final acquittal and the man was released after two months in custody.
For defense attorney Philipp Wolm, it was incomprehensible that the prosecution had even brought charges in this case and had his client imprisoned. The accusations are based solely on the statements of a man who accused his client of having a sexual relationship with his partner – this man even stabbed his client out of jealousy, Wolm reported. In fact, there was a court case that ended last year with a final conviction of several years in prison for intentional grievous bodily harm.
“There was no evidence”
Despite this, the public prosecutor’s office took up the drug allegations against the stabbed man, “even though there was no other evidence other than the incriminating statements of this one witness,” as defense attorney Wolm now noted before a jury (chaired by Peter Sampt). The witness for the prosecution left a questionable impression when he appeared in court, as he entangled himself in contradictions and “was not per se convincing. You cannot base a conviction on such a witness,” as the presiding judge noted afterwards. The judge said in his justification for the Senate’s decision that the witness’s aggression against the defendant was also felt. Overall, there are “enough motives that suggest that he wrongly incriminated the defendant.”
After the final acquittal, the 31-year-old’s legal representative wants to claim compensation. Wolm emphasized that he missed the newborn baby’s first few weeks at home and instead spent this time in a cell in the Josefstadt prison (JA).
