Shein, AliExpress and more: government wants to end import exemption

The government of President Luiz Inacio Lula da Silva wants to end the exemption on international orders with a value of less than US$ 50 (something around R$ 250) exclusively for individuals. The information was confirmed by the special secretary of the Federal Revenue, Robinson Barreirinhas.

As reported to O Globo and UOL, the rule has been misused by legal entities to circumvent the Brazilian taxation system.

This distinction is only serving for widespread fraud in shipments. Our proposal is to unify this situation, that is, not to open this discussion that is more prone to fraud than anything else.

Sources at the Ministry of Finance also say that Asian retailers such as Shein, Shopee and others have been improperly naming individuals as sender to circumvent the Brazilian Federal Revenue Service.

Members of the Revenue still say that Shein has also split shipments into several packages that arrive in Brazil as if they were sent by individuals. As a result, each shipment falls below the exemption threshold and enters the country without paying taxes.

To resolve the issue, the text ending the exemption must be presented as a Provisional Measure (MP). In addition, the Federal Revenue must also implement an electronic system for companies to register information about shipped products in advance.

As a result, taxation may happen automatically, and Correios and private carriers should expand collaboration with the tax authorities.

The company has every interest in declaring correctly, otherwise the cost for it will be great. If you do not make this declaration in advance and the item arrives without a declaration or is incorrect, you will have to return it. Or the carrier will destroy it, if the sender does not want to pay for this return. That is: someone will pay a high cost for irregular transport.

Barreirinhas also said that taxation at 60% will be maintained, and the government also intends to exclude the differentiation between orders from legal entities and individuals.

We are going to determine the obligation of complete and advance import declarations, with complete identification of the exporter and importer, with a fine in case of under-invoicing or incomplete data.
