The Senate Containment Block will challenge before the National Supreme Court of Justice 18 of the 20 decrees approved in the last session of the ordinary period, known as “Black Friday”, and will present a total of 12 unconstitutionality actions.

In an interview following a meeting between the parliamentary coordinators of the PAN, PRI, PRD, Movimiento Ciudadano and Grupo Plural, PRD member Miguel Ángel Mancera explained that in principle, actions of unconstitutionality will be filed in two aspects: for violations of the legislative process and for the substance of each law.

“I give an example: in the case of the mining law, what would be the procedure itself that was carried out at the time it was voted and all the parliamentary process, and the substance, which touches more towards the parties of the consultation , towards the criminal types in white, what it contains, etc., then the Supreme Court, When analyzing, you would have these two types of legal analysis contrast, one like the one that is being determined now from Plan B, which invalidates due to procedural defects, and another that would have to be in the background. If you invalidate the procedure due to vices, it no longer enters the fund, that is enough,” he specified.

Mancera Espinosa explained that as the decrees are published in the Official Gazette of the Federation, unconstitutionality actions will be filed, for which there is a period of 30 business days from their promulgation.
