An inmate of Bulgarian origin, who was transferred from prison following perceiving himself as a woman, impregnated an inmate in the female module, publishes the Spanish newspaper The world. The news opened a strong controversy on social networks following the entry into force in 2023 of the so-called Trans Law promoted by the Spanish Government.
The inmate was admitted to the Fontcalent prison (Alicante, Spain) as a man and, once behind bars, while serving his sentence, declared that he felt like a woman and requested that he be transferred to the women’s module, a request that was granted. In this new prison he established a relationship with another inmate who became pregnant.
The inmate -now transsexual- is a repeat offender. “She has numerous records for robberies and crimes once morest public health and she had already been imprisoned in Fontcalent on several occasions before, always as a man in cells in the male module,” the Spanish newspaper reports.

During the year, she stated that she wanted to change her gender, that she felt like a woman – specifically, a woman with a lesbian sexual orientation. Because following finding out that she had impregnated one of the compañeras with whom she shared a ward, according to union sources quoted by ‘El Mundo’, the prison management returned her to the men’s ward once more.
The pregnant inmate, a Spanish national, considered terminating the pregnancy, but finally went ahead with the pregnancy in prison.
The trans prisoner, on the other hand, no longer remains in the Alicante jail.
The events, according to the same sources, occurred in “January or February” last, before the so-called Trans Law came into force on March 2, which allows the change of name and sex in the Civil Registry from 16 years of age without having to provide a medical report indicating that they suffer from gender dysphoria and without having previously started hormone treatment.
In Spanish prisons, however, issues that affect transsexual people have been regulated since 2006 by instruction 7/2006 on “Prison Integration of Transsexual People”.
The facts were also advanced by Ok Diario, and were ratified to El Mundo by prison union sources.
The transsexual inmate in question, of Bulgarian origin, was quite well-known at the Alicante Fulfillment Penitentiary Center – as the Fontcalent prison is officially called – since she was a repeat offender. She had a long history of robbery and crimes once morest public health, fundamentally, and she had been imprisoned in Fontcalent several times before, always as a man and always occupying a cell in the male module.
Prison workers say they are in a “legal limbo”Therefore, although the Trans Law has been in force for months, there is still no instruction that determines how it should be applied in prisons.
“Since this law began to be processed, we already warned that the differentiating fact of prisons had to be taken into account. The Penitentiary Law is one of the few, if not the only one, that segregates by sex and this is something that has not taken into account the so-called Trans Law”, laments Joaquín Leiva, spokesman for ACAIP-UGT.

In addition to this prisoner, another prisoner had been transferred to the women’s unit following perceiving himself as such. After learning of the inmate’s pregnancy status, the trans prisoner was taken back to the men’s module and, according to prison sources, they were ordered “two shifts in the showers” to avoid new sexual contacts. On the other hand, there are no records of the second trans inmate in prison, reported OK Diario.
