The intervention was made as “amicus curiae” (friend of the court), whose function is to provide contributions for the resolution of the case, along with the union’s lawyer, Federico Egea.
The professional pointed out that it is the obligation of the jury to incorporate the gender perspective as “part of due process of law.” He indicated that it is not an “optional” approach, but that it must be present in all instances. He said that what it is regarding is “make visible the asymmetries” that exist in gender and power relations, and this must be reflected in the sentence.
Egea stated that during the jury Villegas was appointed as “the doctor”, while the female workers were mentioned as «dumb, incompetent, vague». “That clearly shows us the gender asymmetries that surrounded this situation,” she added.
He remarked that «the form of defense exercisenot only did it not respect minimum standards of gender perspective as an integral part of due legal process, but also symbolically and materially presented itself as a perpetration and perpetuation of a previous exercise of violence«.
This alludes to the constant disqualifications of the complainant, María Soledad Garayo, whom they called a liar, emphasized that she was not a victim, and maintained that she was never trained for her job.
The lawyer emphasized that the defense theory of the case focused on Garayo being a bad person, when the focus of the debate should be on whether or not the judge committed poor functional performance.
“They defended themselves in the same violent way for which they were brought to trial. They reproduced the violence that they had been sustaining and that determined the existence of this process, and that has to be especially pondered,” added Egea.
Guzmán Doblas recalled that the judiciary of the province still owes a protocol of action in situations of violence. “I assume the commitment to insist for its prompt resolution,” he said.
The leader assured: “I celebrate the courage of Soledad who had the courage to break the silence, but who also endured and put your physical and mental health at risk.
