Savage Justice: Austrian Court’s Stunning Acquittal in Fatal Mauling Leaves Community Reeling

The animal owner’s daughter, who was in charge of the Rottweiler during the incident in July 2023, had to answer for negligent homicide and negligent bodily harm. A 52-year-old woman died in hospital after the attack and two children were injured. The judgment of the Bruck ad Leitha district court is not legally binding.

According to the public prosecutor’s office, the then 20-year-old did not provide the dog with a muzzle and leash quickly enough on July 26 of the previous year and did not catch him quickly enough when he ran out of a garden onto the street. A woman and her two grandchildren were attacked; the Rottweiler is said to have bitten several times. The 52-year-old and a two-year-old were flown to the hospital, and a seven-year-old was also transported to a hospital. The grandmother died on October 6th of multi-organ failure; according to a report, the bite injuries were the causal factor in her death.

Even if the defendant had taken the leash and muzzle with her immediately, it would not have been certain that she would have been able to keep the dog on a leash, according to media reports, the judge justified the acquittal. The garden gate was therefore locked and the dog had squeezed through a 13 centimeter gap under the gate.
