Sale of land to non-nationals is prohibited, confirms the Constitutional Court –

In a decision widely circulated on social media, the Constitutional Court, seized by the Gabonese Prime Minister, Raymond Ndong Sima, confirmed that the sale of land to non-nationals is prohibited in Gabon, subject to exceptions provided for by law.

« The sale of land in the Gabonese Republic is prohibited to non-nationals, subject to exceptions provided for by law. “, according to the decision rendered by the Constitutional Court on September 19.

The Court was seized on September 13 by the transitional Prime Minister, Raymond Ndong Sima, who asked the constitutional judge to know ” if the ban on the sale of land to non-nationals in the Gabonese Republic, set out in 2th paragraph of Article 28 of the Transition Charter, is applicable to all categories of non-national persons, in particular diplomatic and consular representations, international organizations and companies under foreign law ».

The Court’s response is therefore clear. However, the decision provides for exceptions.

The decision does not specify what will happen to foreigners who have already acquired land in Gabon even though the law is not retroactive.
