Pursuant to Article 3 of Decree 92/2009/ND-CP, the Chairman of the Commune Veterans Association is a full-time officer at the commune.

Thus, the retirement age of the President of the Veterans Association is the same as that of ordinary commune officials. Accordingly, in Article 31 of the Law on Cadres and Civil servants 2008, the retirement age of cadres is as follows:

1. Cadres are retired according to the provisions of the Labor Code.

2. Six months before the cadre retires, the agency, organization or unit that manages the cadre must notify the cadre in writing of the time of retirement; 3 months before the date of the cadre’s retirement, the agency, organization or unit managing the cadre shall issue a decision to retire.

3. In special cases, cadres holding the position of a Minister or equivalent or higher may have their working time extended according to the regulations of the competent authority.

Referring to Article 169 of the Labor Code 2019 on retirement age:

The retirement age of employees under normal working conditions is adjusted according to the roadmap until reaching 62 years of age for male employees in 2028 and full 60 years of age for female employees in 2035.

From 2021, the retirement age of employees under normal working conditions is full 60 years and 3 months for male employees and full 55 years and 4 months for female employees; following that, every year increase by 3 months for male employees and 4 months for female employees.

Employees with reduced working capacity; doing particularly heavy, hazardous or dangerous occupations or jobs; doing heavy, hazardous or dangerous occupations or jobs; working in areas with extremely difficult socio-economic conditions may retire at a lower age but not exceeding 5 years of age at the time of retirement, unless otherwise provided for by law.

Employees with high professional and technical qualifications and in some special cases may retire at an age higher than 5 years old but not more than 5 years old compared to the above normal retirement age at the time of retirement, unless otherwise specified. otherwise provided by law.
