Finally, on July 6, the Chamber of Deputies approved the Elimination of the “Proof of Life” requirement for retirees, pensioners and holders of non-contributory pensions. It was the certification of survival that allowed to perceive the monthly assets without interruptions.
Lawyers specializing in the subject assure that it is great news for retirees and pensioners because it was a strong “emotional and temporary charge”.
It is worth remembering that this requirement had been ineffective during 2020 and 2021 due to the pandemic and although it was reestablished as of March 2022, at that time ANSES asked the banking entities to offer digital alternatives to simplify the process.
In any case, it continued to hinder the daily life of the elderly in various aspects. This is how specialist lawyers in the area explained it to PROFILE.
Florence Markarian, specialist in pension issues, indicated that this procedure not only blocked the collection of assets but was a constant reminder of the “finiteness of life” at a crucial moment for those who receive retirement assets and pensions.
“With the requirement to prove life, both retirees and pensioners were forced every month to prove that they were still alive. And somehow they felt aggrieveds, for having to prove that they were still alive. Because this was a reminder of the finiteness of life at a time when such thoughts are prevalent,” he said.
In this line of analysis, he recalled that “beyond solving the procedures to collect their assets and not depend on the proxies, they also eliminate this feeling that at a certain age having to prove that one is still alive,” he said.
The Senate approved a project that eliminates the “life faith” for retirees

What changed?
It is worth remembering that already on April 13, the project to modify law 26,704 it had received half a sanction in the Senate with 60 affirmative votes. Almost three months later, her treatment was included through a request for departure from the regulations requested by the official deputy Paula Penacca and vote recorded 170 adhesions, 3 negative votes and 6 abstentions.
This modification allows that, of the 7.3 million retirees within the pension system, more than 3.2 no longer have to present the Faith of life following this approval.

The article establishes that “in no case may additional procedures be required by the beneficiary and/or representative of the” retirement benefit “beyond the verifications carried out at the time of the face-to-face collection that is eventually carried out”.
In any case, it still remains to be published in the Official Gazette, when it will actually be possible to have a more exact picture of how the procedures will continue.
At the moment, since ANSES is not the one requesting the proof of life but the banks, each entity has requirements, among which the most frequent is the use of the debit card, for example. From now on, all banks must comply with this Law, which eliminates the “certification of life” procedure.
How has the “life certificate” process been fulfilled so far?
ANSES remembers that the bank where the retirement or pension is collected determines the frequency and the way to carry out the process.
The most used forms for residents in Argentina are:
Make a purchase with the debit or credit card associated with the social security bank account. Carry out procedures in ATMs using the fingerprint. Put the fingerprint on the ANSES totems that are in bank branches. Through a biometric self-consultation Terminal located in the ANSES Offices, in case you have to attend to carry out another procedure.
The pension organization recalls that in cases in which the bank suspends the collection of retirement or pension for not carrying out the Life Certificate, the beneficiary must use the non-face-to-face means offered by the bank and within 2 business days you will have accredited having.
Also, can be done by placing the footprint on the totems of self-management located next to the ATMs of most bank branches.
A group of retirees must continue to do the “life certificate” process
Beyond what is approved, there is a group of retirees who receive the Spanish pension of the National Institute of Social Security (INSS) and the Social Institute of the Navy (ISM) that they must send an annual proof of life to receive the corresponding assets.
The process is sent annually by means of an original document, in a term that goes from January 2 to March 31. The delivery must be made to the Provincial Directorate that corresponds to each beneficiary.
He Ministry of Labor and Social Security of Spain indicates three ways to accredit the faith of life from Argentina:
Certificate of Evidence of Life and State issued by the General Consulate of Spain corresponding to its demarcation. Certificate of appearance issued by this Ministry of Labor, Migrations and Social Security. Certificate of Faith of Life and Marital Status issued by a notary with the Apostille of The Hague.
Survival certificates that are not valid for the Spanish Social Security authorities are those issued by the Police or the National Registry of Persons.
