In particular, the changes concerning all citizens living and working in our country, as well as all expatriates, are focused on six axes.
1. For the first time, a right of inheritance is recognized for people who do not have a marital relationship with the deceased, but are life partners, that is, they have lived together for a long time or in the case that no property has been transferred to them by will. Until now, only the legal spouse has the right to inherit, even if the marital relationship is formal or they are separated for years, complicating and depriving those in real relationships of the possibility to inherit assets.
2. The inheritance right of the parents is severely limited and even abolished in the cases where the parents of the deceased inherit, when they are old, i.e. over 80 years old. Until today, the children, if they exist, the wife and if there are no children, the parents of the one who leaves life, have the right to inherit, in percentages that differ from case to case. Henceforth, elderly parents will not inherit at all, just as spouses will not inherit at rates that apply today, which, if the conjugal relationship is formal, their right to inherit will be drastically limited.
3. The new regulations allow for the first time in Greek data the conclusion of inheritance contracts, which is now expressly prohibited, and even if it is done, it has no legal force. Inheritance contracts, which are valid in many countries of the world (including the European Union), give the possibility of free disposal of the property, as for example a living parent can call his children and agree with them by inheritance contract what he will get each of his property and that the inheritance should not be based on the percentages of the legal destiny (which defines what everyone inherits without any substantial will of the one whose property is inherited).
4. If after a certain period of time, the heirs are not interested, their right to inheritance is barred and the property goes to other heirs. The statute of limitations on the inheritance right for those who are not interested for years mainly concerns expatriates and their children, something which is so common in our country, where the abandonment of property, because e.g. some relatives are in America or Australia and they don’t consent or don’t care, it leads to complete disqualification.
5. Finally, it changes the framework for wills, which from now on will only be digital and drawn up and published by a notary, in order to put an end to handwritten wills, which usually cause huge problems for heirs, as there are usually more than one , with contradictory instructions or arrangements that do not make sense, with doubts in the signature of the one leaving his property.
